Terms And Conditions

Introduction
This Terms and Conditions of Service Agreement ("Agreement") sets forth the terms and conditions governing the contractual relationship between Dr. Green Cuts LLC ("Dr. Green Cuts" or "Contractor") and its clients ("Client") for the provision of lawn care services. By accepting any estimate, quote, or proposal, the Client acknowledges understanding and acceptance of these Terms and Conditions for both current and future services.

Effective Date
This Agreement becomes effective upon the acceptance of an estimate, quote, or proposal and remains valid for a minimum period of two calendar years (730 days) from the date of the last service rendered, unless terminated earlier by either party in writing. This includes both one-time jobs and recurring services.

Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information exchanged during the course of their engagement. This includes but is not limited to business strategies, customer data, pricing, and operational processes. Neither party shall disclose such information to any third party without prior written consent.

10. Intellectual Property Rights

All content, trademarks, logos, and other intellectual property rights associated with our Services are the property of Dr. Green Cuts LLC or our licensors. You are granted a limited, non-exclusive, revocable license to access and use our Services for personal use only.

Governing Law and Dispute Resolution
This Agreement shall be governed by and construed in accordance with the laws of the State of Florida. Any disputes arising out of or in connection with this Agreement shall be resolved through informal negotiation between the parties. If the parties are unable to resolve the dispute informally, they agree to submit to the exclusive jurisdiction of the courts located in [City/County], Florida.

Scope and Pricing
The scope of work ("SOW") and pricing for services provided by Dr. Green Cuts may vary based on factors such as property size, complexity of the job, and specific client requirements. Estimates provided are based on the information available at the time of estimation and are subject to change upon further inspection or unforeseen circumstances. Any significant changes to the scope of work or pricing will require written approval from both parties.

Invoicing and Payment Terms
Upon completion of services, Dr. Green Cuts will issue an itemized invoice to the Client detailing the work performed and the corresponding charges. Payment is due upon receipt of the invoice unless otherwise specified. Late payments, of 5 Days or more, are subject to a late fee of $25 or 5% of the outstanding balance, whichever is greater. Dr. Green Cuts reserves the right to withhold services and/or materials for overdue accounts.

Renewal of Recurring Services
Recurring services provided by Dr. Green Cuts, such as seasonal lawn maintenance or pest control treatments, will automatically renew each season unless otherwise terminated by the Client in writing at least 72 hours prior to the scheduled service visit. Termination of recurring services does not affect any other ongoing contractual obligations between the parties.

Holidays

Schedules may be moved forward or back due to a week day holiday.

Inaccessible Yards: Once the service team arrives we begin our systematic approach to servicing your lawn. In order to provide timely, efficient and dependable service WE DO NOT CALL OR KNOCK on the door if a yard is inaccessible. Our team will note the work order the reason why an area was not serviced. We do not offer credits or redo’s for missed areas due to inaccessible yards. If a trip is made and we were unable to service any areas the regular service fee will be charged. If you request a return trip the regular service fee applies and service is rescheduled when we are in the area.

Inaccessible Yards include but are not limited to: locked gates; broken gates; ongoing projects; moving vans; too many parked cars; pets outside; outdoor parties; irrigation running; construction material or workman in a yard.

Combination Locks: With a combination lock we can guarantee your peace of mind and insure our ability to service your property. If you already have a combination lock let us know and we’ll keep the number on file.

Locked Gates: Our service teams are careful about locking and closing gates, if security is a concern, please make a quick check of the gate and lock for closure after our service to ensure the gate is secured and please contact us if you find the gate/lock open, we will remind the service team to lock every time! However, we cannot guarantee a gate will latch and the lock is in place. You accept our service with these terms.

Pets: Our service teams love pets; not all pets love us! We are careful about locking and closing gates, but, we cannot guarantee a pet will not escape. We recommend keeping your pets inside on service day and check the gate for closure after service to ensure it is latched before releasing your valuable pets into the yard. You accept our service with these terms.

Notices to Clients
A. Lawn Care / Pest Control

1. Lawn care packages are subject to automatic renewal annually and require a      minimum commitment period.
2. Seeding rates for lawn overseeding or aeration and overseeding services are      approximately 6lbs/1000sqft.
3. Clients are responsible for marking any underground utilities or obstacles that      may be damaged during core aeration or seeding services.

B. Property Damage

While we take utmost care in providing our lawn care Services, Dr. Green Cuts LLC shall not be liable for damages to your property arising from our Services, except in cases of gross negligence or intentional misconduct by our employees. We encourage you to identify and mark any hazards on your property.

C. Limitation of Liability

To the extent permitted by law, Dr. Green Cuts LLC shall not be liable for any indirect, incidental, special, or consequential damages, including but not limited to, loss of profits, revenue, data, or use, incurred by you or any third party, whether in an action in contract or tort, arising out of or relating to the provision of our Services.

D. Mowing Services

1. Clients      are required to remove any items from the lawn before scheduled mowing      services to avoid damage or interference with equipment.
2. A      cleaning fee may be applied for excessive pet waste left in the lawn, with      prior notification to the Client.
3. Cancellation      requests for mowing services must be received by 48 hours before the      scheduled service day to avoid penalties.
4. All turf areas will be mowed to maintain with blades set at height of 3.0''- 4.5''   throughout the mowing season - unless requested otherwise. All mower blades are to be sharp to ensure smooth cutting of the grass blades. If we feel your turf is not in need of service due to conditions  of the turf, we will not perform the service. In conjunction with each mowing, trimming will be performed around all objects in the turf areas, such as trees, utility boxes, light posts, shrubbery beds, etc.  All  sidewalks, asphalt paths and concrete curbs shall be neatly edged to produce a clean sharp line of turf. Grass clippings will be blown from the sidewalk, curbs, parking areas with each mowing.
5. Tall Grass: When you sign up for service it is assumed that your lawn is      not  overgrown; and prices are based as such. It takes substantially longer to mow an overgrown lawn and prices may vary based on condition of lawn at time of first service. 
6. Duration of Service: Regular Mowing season is typically end of March through the middle of November depending on growth/weather      conditions. Please note that weather does affect the need for weekly or every other week service and we may change your schedule accordingly.

E. Landscaping / Plants

1. Dr.      Green Cuts guarantees the survival of plants installed for a period of one      year from the date of installation, subject to proper care and maintenance by the Client.
2. Mulch  must be allowed to dry for at least 24 hours after installation to prevent color transfer and ensure proper settling.
3. Landscape design plans and proposals are the intellectual property of Dr. Green Cuts      and may not be shared with third parties without consent.

F.  Payment and Pricing Policy

1. No refunds will be issued for products or materials purchased or delivered to      the job site.
2. Clients  are required to maintain an active and non-expired credit card on file for      invoicing purposes. Failure to provide valid payment information may      result in service disruptions or additional fees.
3. Prices      for our services are subject to change without notice.

G. Changes to Terms

We reserve the right to modify or revise this Agreement at any time. Changes will be posted on our website, and it is your responsibility to review this Agreement periodically for updates.
